1. Pilot status

Augyart is a development pilot operated from Finland. During Sandbox testing, transactions do not move real money and do not create a real artwork sale. A checkout marked live creates a real order under these terms.

The first live phase is limited to artworks sold directly by Edward Stewart as a private individual. Augyart does not currently onboard other sellers, act as a reseller or charge a marketplace commission.

Seller status depends on the substance and scale of the activity, not only its description here. If the activity becomes regular or otherwise constitutes business, the seller will update the status, registrations and terms before continuing trader sales.

2. Augyart and the seller

For an eligible pilot listing, the purchase contract is directly between the buyer and Edward Stewart, Finland, acting as a private individual. The seller contact is stewart.eddie@gmail.com. The same seller identity and status are repeated beside live checkout.

Augyart supplies the artwork presentation, order record and PayPal connection for this direct sale. It is not a separate seller or commercial intermediary in the current single-seller pilot.

The Finnish Consumer Protection Act and its statutory 14-day distance-selling withdrawal right do not ordinarily apply to a genuine sale between private individuals. The Sale of Goods Act, the agreed listing and these terms govern the transaction. The voluntary return promise below gives the buyer an additional contractual option.

3. Artwork information

Listings describe the original work, artist, year, medium, dimensions, condition and availability as accurately as reasonably possible. Screen colours and scale previews are illustrative and may differ from the physical work.

The seller remains responsible for the accuracy, authenticity, lawful ownership and safe supply of the artwork and for correcting material listing errors before accepting a live order.

4. Orders and payment

• The total payable price, applicable taxes, delivery charge or an agreed collection option must be shown before a live payment can be placed.
• Where delivery requires an individual quote, online payment must remain unavailable until that quote is accepted; the buyer may instead contact the artist.
• A live purchase contract is formed when payment is captured and Augyart confirms the order. The buyer receives or can retain the applicable terms and order information.
• PayPal processes the payment under its own terms. Augyart does not receive the buyer’s full payment credentials.

5. Delivery, collection and risk

Checkout states whether the displayed price includes delivery or whether the purchase is collection-only. A work requiring a separate delivery quote remains inquiry-only until the delivery terms and total price are agreed.

The seller and buyer will agree a reasonable collection or dispatch time in writing. When the seller selects the carrier, the seller remains responsible for appropriate packaging and will assist with any transit claim. Buyers should photograph visible package damage and contact the seller promptly.

6. Withdrawal, returns and defects

For a standard artwork bought through live checkout, the private seller voluntarily allows the buyer to cancel by sending a clear written notice within 14 days after delivery or collection. This is a contractual pilot promise, not a statement that the statutory consumer withdrawal regime applies.

After giving notice, the buyer must return the work within 14 days, in the condition received and using protective, tracked and appropriately insured transport. The buyer pays the direct return cost unless the seller agrees otherwise. The seller may wait to refund the captured purchase amount until the returned work or reliable proof of return is received.

The voluntary return option does not apply to a clearly commissioned or personalised work when that exclusion was agreed before payment. It does not remove the buyer's rights where an artwork is materially misdescribed, inauthentic, damaged before risk passed or otherwise defective under the applicable agreement and law.

7. Copyright and permitted use

Buying a physical artwork transfers ownership of that physical object only. Copyright and reproduction rights remain with the artist or other rights holder unless a separate written agreement says otherwise.

Augyart content, images and software may not be copied, scraped, republished or commercially exploited without permission, except where law permits.

8. Complaints and disputes

Buyers should first contact the identified seller in writing and include the order reference, a clear description of the issue and supporting photographs where relevant.

Finnish consumer advice and the Consumer Disputes Board generally do not resolve disputes between two private individuals. If direct discussion does not resolve a private-sale dispute, the parties may seek independent legal advice or bring the matter before the competent Finnish court.

9. Governing law and changes

Finnish law governs these terms, without depriving consumers of mandatory protections available in their country of residence. The version accepted at checkout applies to that order. Material changes apply only prospectively.
